These Terms of Service (“Terms”) govern your access to and use of the Tour Anywhere mobile application (the “App”) and the website at touranywhere.app (the “Website”), operated by Tour Anywhere (“we,” “us,” or “our”). By downloading, installing, or using the App or Website, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use our services.

1. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you represent that you have your parent’s or legal guardian’s permission to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

2. Account Registration

To access certain features, you must create an account using Apple Sign-In, Google Sign-In, or email and password. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us promptly of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Description of Services

Tour Anywhere provides AI-generated walking and driving tours for locations worldwide. Our services include:

  • AI-powered discovery of points of interest for any location
  • Generation of narrated audio tour content for each stop
  • Route planning and mapping between tour stops
  • Saving and managing tours within your account

4. Subscription Plans and Payments

4.1 Tiers

The App offers the following subscription tiers:

  • Free: One tour total, standard voices
  • Explorer ($6.99/month): 10 tours per month, standard voices, tour history
  • Pro ($9.99/month): Unlimited tours, premium voices, tour history

Prices are in USD and may vary by region. We reserve the right to change pricing with reasonable notice.

4.2 Billing

Subscriptions are billed monthly through your Apple App Store account. Payment is charged at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

4.3 Cancellation

You may cancel your subscription at any time through Apple’s subscription management settings on your device. Cancellation takes effect at the end of the current billing period. You will retain access to your subscription features until the period expires. We do not offer refunds for partial billing periods.

4.4 Free Trial

If a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless cancelled beforehand.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws
  • Attempt to reverse-engineer, decompile, or disassemble the App
  • Interfere with or disrupt the App’s servers, networks, or infrastructure
  • Use automated means (bots, scrapers, etc.) to access the App or generate tours in bulk
  • Resell, redistribute, or commercially exploit tour content generated by the App without our written permission
  • Circumvent subscription restrictions, entitlement checks, or usage limits
  • Impersonate another person or misrepresent your affiliation with any entity
  • Upload or transmit harmful code, malware, or other destructive content

6. AI-Generated Content

6.1 Nature of Content

Tour narrations, point-of-interest descriptions, and other textual and audio content in the App are generated by artificial intelligence. While we strive for accuracy, AI-generated content may contain inaccuracies, outdated information, or errors.

6.2 No Guarantee of Accuracy

We do not warrant that tour content is accurate, complete, current, or reliable. Historical facts, opening hours, accessibility information, and other details provided in tour narrations should be independently verified before relying on them.

6.3 Your Use of Generated Content

Tours generated for your personal use through your account are provided for your personal, non-commercial enjoyment. You may not reproduce, distribute, or publicly perform tour narrations or audio for commercial purposes without our prior written consent.

7. Location Data and Safety

7.1 Location Permissions

The App requires access to your device’s location services to generate tours near you. You may revoke location permissions at any time through your device settings, though this will limit the App’s functionality.

7.2 Safety Disclaimer

Tour routes are generated algorithmically and may pass through areas that are unsafe, inaccessible, under construction, or otherwise unsuitable for pedestrians or vehicles. You are solely responsible for your personal safety while following any tour route. Always:

  • Exercise caution and use common sense when navigating unfamiliar areas
  • Obey all local traffic laws, signs, and regulations
  • Be aware of your surroundings, especially when using headphones
  • Do not trespass on private property, even if a tour stop suggests a location nearby
  • Verify that paths and roads are open and passable before proceeding

We are not responsible for any injury, loss, or damage arising from your use of tour routes.

8. Intellectual Property

8.1 Our Property

The App, Website, and all associated software, designs, trademarks, logos, and branding are owned by or licensed to Tour Anywhere and are protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

8.2 Third-Party Content

The App incorporates data and services from third parties, including Google Maps, OpenAI, Google Gemini, and ElevenLabs. Your use of the App is also subject to the terms and policies of these third-party providers.

9. Disclaimer of Warranties

THE APP AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, error-free, or free of harmful components
  • Tour content will be accurate, complete, or current
  • The App will be available at all times or in all locations
  • Defects will be corrected in a timely manner

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TOUR ANYWHERE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Tour Anywhere and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. You may terminate your account at any time by deleting it through the App’s Settings screen. Upon termination, your right to use the App ceases immediately and all data associated with your account will be deleted in accordance with our Privacy Policy.

13. Modifications to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Website and updating the “Effective Date” above. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the App shall be resolved in the state or federal courts located in the United States, and you consent to the personal jurisdiction of such courts.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tour Anywhere regarding your use of the App and supersede any prior agreements.
